Public Records Request


The Administrative Procedures Section (APS):

  • Gathers public records in compliance with Idaho Public Law for the Department of Health and Welfare; and
  • Assists the Department of Health and Welfare in developing its rules according to Idaho Code §§67-5201 et. seq., Administrative Procedures Act.

Public Records

 

The intent as stated in the Idaho Public Records Law Manual by the Idaho Legislature "is that all records maintained by state and local government entities be available for public access and copying. At the same time, the Legislature recognizes the need to balance the policy of openness against the equally important need for privacy of certain information provided by citizens and businesses that is necessary for the government's business. This balance is contained in Idaho Code §9-338, which states that "all public records in Idaho are open at all reasonable times for inspection except as otherwise expressly provided by statute."

 

To Request a Public Record

  • You must make the request in writing. You must include the requester's name, address and telephone number in the request.
  • Your request must be very specific, including dates, locations or names of reports if they apply to your request.
  • If you make a request regarding a family member or client, you must include a release signed by that person.
  • If you are requesting client-specific information, you need to complete this form. Your signature must be notarized if you submit this request by mail or fax, and you will need to have identification if you submit this form to a local Health and Welfare office.

How long will it take for my request to be answered?

 

Three (3) working days from the time APS receives the request.

If the request cannot be filled within three (3) working days, APS will extend it to ten (10) working days from date of receipt. The requester will be notified if this is the case.


Is there a cost?

 

If the request involves copying 100 pages or more, there is a cost of 10 cents a page. The requester will be notified of any charges prior to the materials being mailed. If you have questions about Public Records, call 208-334-5552 or 208-334-5564.
